Yes, a garden suite always needs a building permit
A garden suite is not a shed or a bunkie; it is a self-contained home with a kitchen, bathroom, sleeping area, heat, water, sanitary drainage, and electrical service. That makes it a new dwelling unit under the Ontario Building Code, and a building permit is mandatory everywhere in the GTA, along with the associated plumbing, HVAC, and electrical approvals and a series of inspections during construction. Small unserviced accessory structures, generally under about 15 square metres with no plumbing, can be exempt from permits in Ontario, but nothing you live in ever is. Building without a permit exposes you to stop-work orders, fines, forced removal of completed work, insurance problems, and serious complications when you sell, and an unpermitted suite cannot be legally rented with confidence. Because the suite is a full dwelling, the application also needs proper drawings: a site plan, architectural and structural drawings, energy-efficiency compliance, and HVAC design. Since February 2022, garden suites have been permitted as-of-right city-wide in Toronto, and under Bill 23 and O. Reg. 462/24 most residential lots across Ontario can now have up to three units as-of-right, which can include a detached garden suite. As-of-right means that if your design complies with the zoning performance standards, things like the 60-square-metre floor-area cap in Toronto, setbacks, height, angular planes, separation from the main house, and lot coverage, you do not need a rezoning application, a public meeting, or your neighbours' sign-off. You go straight to a building permit. If your design pushes past a zoning standard, for example a slightly taller suite or a reduced setback on an awkward lot, you would need a minor variance from the Committee of Adjustment, which adds public notice, a hearing, and typically several extra months. How long permits actually take
